Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Romonox's website, mobile application, products, and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
Purchases
If you purchase any goods, services, subscriptions, or other offerings made available through the Service (each, a "Purchase"), you may be required to provide information relevant to the Purchase, including billing details, contact information, and other information needed to process the transaction.
You represent that all purchase information you provide is accurate, complete, and current, and that you are authorized to use the payment method you provide.
Subscriptions
Some portions of the Service may require a paid subscription ("Subscription"). Subscription fees are billed in advance on a recurring basis according to the billing cycle you select, such as monthly or annually.
Unless you cancel before the renewal date, your Subscription will automatically renew at the end of each billing cycle. You may cancel your Subscription through your account settings or by contacting Romonox customer support. Cancellation will take effect at the end of the then-current billing cycle unless otherwise stated at the time of purchase.
By providing payment information, you authorize Romonox and its payment processors to charge all applicable Subscription fees, taxes, and other charges to your selected payment method. If automatic billing fails, we may send you an invoice or attempt to charge your payment method again.
Free Trial
Romonox may offer a Subscription with a free trial for a limited period ("Free Trial"). We may require billing information to start a Free Trial.
If you provide billing information for a Free Trial, you will not be charged until the Free Trial ends. Unless you cancel before the Free Trial ends, your Subscription will begin automatically and you authorize us to charge the applicable Subscription fees.
Romonox may modify or end any Free Trial offer at any time, to the extent permitted by law.
Fee Changes
Romonox may change Subscription fees at its discretion. Fee changes will take effect at the end of the current billing cycle or at another time disclosed to you.
We will provide reasonable advance notice of material fee changes when required by law or when the change applies to a renewing Subscription. Your continued use of the Service after the fee change takes effect means you agree to pay the updated fee.
Refunds
Payments are non-refundable except where required by law or expressly stated by Romonox in writing. Romonox may review refund requests on a case-by-case basis and may approve or deny them at its sole discretion.
User Content
The Service may allow you to upload, submit, store, send, receive, or share information, text, images, videos, links, or other materials ("User Content"). You are solely responsible for your User Content, including its legality, reliability, accuracy, and appropriateness.
You retain ownership of your User Content. By submitting User Content to the Service, you grant Romonox a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, perform, distribute, and otherwise use your User Content as necessary to operate, provide, improve, and promote the Service.
You represent and warrant that you own your User Content or have all rights needed to grant the license above, and that your User Content does not violate any law or any third party's privacy, publicity, intellectual property, contract, or other rights.
Romonox may, but has no obligation to, review, block, remove, or refuse to display User Content that we believe violates these Terms, the law, or the rights or safety of others.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. If the Service includes community, messaging, collaboration, or user-generated content features, you are responsible for everything you submit or share through those features.
You may not use the Service to submit, publish, upload, display, distribute, or transmit any content or activity that:
- defames, abuses, harasses, stalks, threatens, or otherwise violates another person's legal rights;
- infringes, misappropriates, or violates intellectual property, privacy, publicity, confidentiality, or proprietary rights;
- contains unsolicited advertising, junk mail, spam, surveys, sweepstakes, chain letters, or other unwanted solicitations;
- creates, encourages, or promotes unlawful activity, civil liability, or conduct that violates any applicable law;
- is fraudulent, deceptive, misleading, obscene, offensive, harmful, or otherwise objectionable; or
- interferes with, disrupts, damages, or attempts to gain unauthorized access to the Service or any related systems.
Moderation and Enforcement
Romonox has no obligation to monitor the Service, but we may investigate violations of these Terms and take action we consider appropriate, including removing User Content, limiting features, suspending accounts, terminating access, or reporting activity to law enforcement.
Romonox is not liable for removing User Content, limiting or terminating access, or failing or delaying to take any moderation or enforcement action.
Accounts
When you create an account, you must provide accurate, complete, and current information. Failure to do so may result in suspension or termination of your account.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify Romonox promptly if you become aware of any unauthorized access to or use of your account.
You may not use a username, account name, or identifier that is unlawful, misleading, offensive, or infringes the rights of another person or entity. Romonox may modify, reclaim, or remove usernames or account identifiers that violate these Terms.
Romonox Intellectual Property
The Service, including its software, design, text, graphics, logos, names, trademarks, service marks, and other content, is owned by Romonox or its licensors and is protected by intellectual property and other laws.
Subject to these Terms, Romonox grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes. These Terms do not grant you any right to use Romonox's trademarks, logos, branding, or proprietary notices without our prior written permission.
Third-Party Links and Services
The Service may contain links to third-party websites, products, or services that Romonox does not own or control.
Romonox is not responsible for the content, privacy policies, practices, availability, or accuracy of any third-party websites, products, or services. Your use of third-party services is at your own risk and may be governed by separate terms and policies.
Termination
Romonox may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, if your use creates risk for Romonox or others, or as otherwise permitted by law.
You may stop using the Service at any time. Termination does not relieve you of payment obligations incurred before termination.
Sections that by their nature should survive termination will survive, including provisions regarding ownership, payment obligations, disclaimers, limitations of liability, indemnification, dispute-related terms, and general legal terms.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Romonox and its officers, directors, employees, contractors, agents, licensors, suppliers, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:
- your access to or use of the Service;
- your User Content;
- your violation of these Terms;
- your violation of any law or third-party right; or
- any activity conducted through your account.
Limitation of Liability
To the fullest extent permitted by law, Romonox and its directors, employees, partners, agents, suppliers, licensors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or other intangible losses, resulting from or related to your access to, use of, or inability to use the Service.
To the fullest extent permitted by law, Romonox's total liability for any claim arising out of or related to the Service or these Terms will not exceed the greater of the amount you paid to Romonox for the Service in the three months before the event giving rise to the claim or $100.
The limitations in this section apply under any legal theory, whether based in warranty, contract, tort, negligence, strict liability, statute, or otherwise, even if Romonox has been advised of the possibility of damages.
Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Romonox disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade.
Romonox does not warrant that the Service will be uninterrupted, secure, error-free, free of viruses or harmful components, or that any defects will be corrected. You use the Service at your own risk.
Legal Exclusions
Some jurisdictions do not allow certain disclaimers, exclusions, or limitations of liability. In those jurisdictions, the disclaimers, exclusions, and limitations in these Terms apply only to the fullest extent permitted by applicable law.
Governing Law
These Terms are governed by the laws of the United States and, where applicable, the laws of the state in which Romonox is organized or principally operates, without regard to conflict-of-law principles.
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.
Changes to These Terms
Romonox may modify these Terms from time to time. If we make material changes, we will make reasonable efforts to provide notice before the changes take effect, such as by posting the updated Terms on the Service or providing notice through the Service.
Your continued use of the Service after updated Terms take effect means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
General Terms
These Terms, together with any additional terms or policies referenced in them, constitute the entire agreement between you and Romonox regarding the Service and supersede any prior agreements regarding the Service.
Romonox's failure to enforce any provision of these Terms is not a waiver of its right to do so later. You may not assign or transfer your rights or obligations under these Terms without Romonox's prior written consent. Romonox may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
